Terms and Conditions

I. Prices & Offers are valid for a certain period: prices are subject to change due to import taxes and price inflation. All quotations and offers are valid for thirty (30) days unless otherwise stated in writing. After expiration, the Company reserves the right to revise prices, cancel the quotation, or issue a new quotation.

II. After a payment is made or a Down Payment is completed the customer must pick up the product within three (3) months. If the customer hasn’t picked up the product within 3 months, then the reserved product will be sold. In case the product is not available after three (3) months, the customer can choose to wait for the next batch of products or choose another product of similar value. The Company shall not be liable for any increase in price, supplier discontinuation, or stock shortages occurring after the three (3) month reservation period.

III. Delivery charges are not included in the purchase price unless expressly stated otherwise. Delivery fees shall be determined by the Company based on the type of product, quantity, location, and delivery requirements. The customer remains responsible for any damage that has occurred to the picked-up products after leaving the premises of the company. If you wish to return an item, you must contact us by writing post, email, phone, to obtain a return authorization. Custom orders, special orders, made-to-order products, clearance items, assembled products, installed products, and products ordered specifically for a customer are non-returnable, non-refundable and non-cancellable. Items must be returned to us in unused condition with all manufacturers’ seals intact and original invoices. The cost of returning an item will be your responsibility, if we agree to collect the item, we will make a charge for this at our cost, which will be greater than our subsidized shipping charges. We reserve the right to charge a 30% restocking fee if we do so, you will be advised of the reason for the charge. You must return the item within 2 working days of us issuing returns authorization.

Down Payment: must be paid in full within three (3) months of time. In case the Down Payment is not fully paid and collected within three (3) months, an additional 30% will be charged as restocking fee over the total/grand price of the product. This paragraph is subject to the conditions of paragraph II. Any deposit, down payment, or amount paid shall be deemed forfeited if the customer fails to complete payment and collect the product within the applicable period, unless otherwise agreed in writing by the Company.

IV. Cancellation of Payment/Down Payment: Any request for cancellation or refund must be submitted to the Company in writing. Products returned within two (2) business days from the date of purchase, in unused condition, with all manufacturers’ seals intact and accompanied by the original invoice, may qualify for a refund at the Company's discretion. After two (2) business days from the date of purchase, no cash refunds shall be provided. Any approved refund shall be issued solely in the form of store credit or a voucher valid for one (1) year from the date of issuance.

Special order products, custom-made products, made-to-order products, installed products, and clearance items are non-refundable and non-returnable. The Company reserves the right to approve or reject any return request at its sole discretion.

V. The installation fee of doors and windows is twenty percent (20%) of the total purchase price of the products.

The Company may charge additional fees for work not included in the standard installation, including but not limited to finishing of wall frames, window frames, masonry work, painting, electrical work, modifications, repairs, or any additional labor required.

All INGCO products are covered solely by the manufacturer's warranty of six (6) months, subject to the manufacturer's terms and conditions. Smart Home Depot does not provide any additional warranty beyond the manufacturer's warranty.

VI. The Company shall only be responsible for manufacturing defects or damage caused by the Company prior to delivery or during transportation arranged by the Company. Except as expressly stated herein, the Company provides no other express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.

Variations in color, shade, texture, grain, finish, pattern, dimensions, measurements, or appearance between samples, catalog images, photographs, display models, and the actual product shall not be considered a defect and shall not constitute grounds for return, replacement, cancellation, or refund.

VII. Any visible damage, shortage, incorrect item, transportation-related damage, or installation-related issue must be reported in writing within two (2) business days after delivery, installation, or pickup. Manufacturing defects must be reported immediately upon discovery and within the applicable manufacturer's warranty period. The original invoice and proof of purchase must be presented for any claim. The Company reserves the right to inspect the product before accepting or rejecting any claim. Claims made without the original invoice or proof of purchase may be rejected by the Company. The Company reserves the right to repair, replace, or reject any claim at its sole discretion. Products that have been installed, modified, altered, cut, drilled, painted, assembled, or otherwise changed from their original condition shall not be eligible for return, refund, exchange, or warranty claim, unless the defect is determined by the Company to be a manufacturing defect.

VIII. Force Majeure: The Company shall not be liable for any delay, failure to perform, or inability to deliver products due to circumstances beyond its reasonable control, including but not limited to supplier delays, shipping delays, customs inspections, customs holds, port congestion, labor disputes, strikes, acts of God, natural disasters, pandemics, governmental actions, shortages of materials, transportation interruptions, or any other force majeure event.

IX. Limitation of Liability: Under no circumstances shall the Company's liability exceed the purchase price paid by the customer for the product giving rise to the claim. The Company shall not be liable for indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of profits, business interruption, loss of use, loss of opportunity, or any third-party claims. The Company's liability shall in all cases be limited to the repair, replacement, or refund of the purchase price of the product, at the Company's sole discretion.

X. Governing Law and Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Curaçao. Any dispute arising out of or relating to these Terms and Conditions shall be submitted exclusively to the competent courts of Curaçao.
